1. Overview & 5-Step Society Workflow
How Maharashtra Co-operative Housing Society maintenance is legally calculated

Calculating monthly maintenance in a Co-operative Housing Society (CHS) in Maharashtra cannot be done arbitrarily. Under the Maharashtra Co-operative Societies Act (MCS Act 1960) and the Model Bye-Laws (Bye-Laws 65 to 71), different expense heads must be divided among members according to strict legal rules:

Step 1 📝
Society Info
Enter registered society name, location, contact & billing cycle.
Step 2 ⚙️
Rates & Parking
Set construction cost, Sinking/Repair %, 2W/3W/4W parking, and Water modes.
Step 3 🛡️
Service Budget
Customize security, housekeeping, lift maintenance & common expenses.
Step 4 🏢
Upload Flats
Upload Excel roster, load 15 demo units, or add flats & shops manually.
Step 5 📊
Instant Results
View itemized calculation table, charts, and export PDF/Excel/WhatsApp.
⚖️
Statutory Principles of Maharashtra Bye-Laws:
  • Equal Division (Bye-Law 66): Security, housekeeping, office staff, electricity & admin charges are divided EQUALLY among all flats regardless of flat size.
  • Area-Based Division (Bye-Law 67a): Sinking Fund (0.25%), Repair Fund (0.75%), and Building Insurance are strictly computed on Carpet Area.
  • Vehicle-Based Division (Bye-Law 69): Charged per registered vehicle (2-Wheeler, 3-Wheeler, 4-Wheeler).
  • Tenancy Surcharge (Bye-Law 68): Non-Occupancy Charges apply only to rented flats, strictly calculated on Service Charges only, and legally capped at max 10%.
📝

Quarterly (तिमाही) Every 3 months 3x Most popular in Mumbai, Pune, Thane & Navi Mumbai societies
Half-Yearly (सहामाही) Every 6 months 6x Small societies collecting twice a year in April & October
Annual (वार्षिक) Every 12 months 12x Societies collecting full year in advance
🏗️ Construction Cost & Statutory Funds
Field Default Calculation Formula & Bye-Law Rule
Construction Cost (₹/sqft) ₹700 Original construction cost per sq.ft determined by the Architect/Builder or registered General Body rate. Used to calculate Sinking & Repair funds.
Sinking Fund % p.a. 0.25% Bye-Law 67(a)(i): Legally fixed at minimum 0.25% per annum of the construction cost of the flat.
Monthly Sinking = Area × Construction Cost × (0.25 ÷ 100) ÷ 12
Repair Fund % p.a. 0.75% Bye-Law 67(a)(ii): Legally fixed at minimum 0.75% per annum of the construction cost of the flat.
Monthly Repair = Area × Construction Cost × (0.75 ÷ 100) ÷ 12
Building Insurance Premium (₹) ₹55,608 Bye-Law 67(a)(iv): Total annual building insurance premium paid by society. Divided among flats strictly in proportion to carpet area.
Flat Insurance = (Annual Premium ÷ 12 ÷ Total Society Area) × Flat Area

4. Vehicle Parking System (Bye-Law 69)
Separate toggles & dynamic auto-hiding columns for 2-Wheeler, 3-Wheeler & 4-Wheeler

Maharashtra CHS Bye-Law 69 empowers the General Body to prescribe parking rates per vehicle. In our calculator, each vehicle type can be turned ON or OFF individually with zero clutter:

🛵 Default ₹100 / mo
Two-Wheeler (2W)
Scooters, motorcycles, and mopeds.
If ON: Shows dedicated 2W Park column.
If OFF: Column is completely hidden and fee is ₹0.
🛺 Default ₹150 / mo
Three-Wheeler (3W)
Auto-rickshaws, commercial tempos.
If ON: Shows dedicated 3W Park column.
If OFF: Column is completely hidden.
🚙 Default ₹300 / mo
Four-Wheeler (4W)
Sedans, SUVs, hatchbacks.
If ON: Shows dedicated 4W Park column.
If OFF: Column is completely hidden.
💡
Progressive Parking Slab (2nd Car at 1.5x Multiplier):
If enabled in Step 2, any member parking 2 or more cars is charged at 1.5 times the normal rate for their cars to discourage hoarding scarce society parking space!
💧
5. Water Billing Options & Auto-Hiding
Support for Equal distribution, Per-Tap, and Fixed monthly billing

Water supply arrangements vary across societies. Our tool gives you complete flexibility over how water charges are billed:

Mode How It Works Formula
Equal (Same for all units) The municipal water bill is divided equally among all flats. Best when all flats have identical family sizes or no sub-meters.
Flat Water = Total Water Bill ÷ Total Units
Per Tap (Bye-Law 67a-iii) Strict legal formula. The bill is divided by total water taps in the society, then multiplied by taps inside each flat (e.g. 1BHK = 1 tap, 2BHK = 2 taps, 3BHK = 3 taps).
Flat Water = (Total Bill ÷ Total Taps) × Unit Taps
Fixed Amount per Unit Each unit pays a fixed flat fee (e.g. ₹500/month) regardless of total municipal bill.
Flat Water = Fixed Amount (₹)
🚫
What happens if Water Bill is toggled OFF?
If your society has free borewell water or water charges are paid directly by individual members to the municipal corporation, simply switch the Water Bill toggle to OFF.
When OFF:
  • The Water column is completely hidden from the Step 5 Table.
  • The Water Charges KPI Summary Card is hidden.
  • Water is excluded from the Doughnut Chart.
  • Water is excluded from PDF, Excel, and CSV export files.
🛡️

13. Common Society Disputes & Legal Solutions
How Maharashtra Co-operative Court & Model Bye-Laws resolve member disputes

Click on any question below to expand the legal verdict and applicable court citations:

⚖️ Legal Verdict: Must Pay Equally (Unless AGM Amends)

Legal Rule (Bye-Law 66 & 160): As per Maharashtra Model Bye-Laws, Lift is a common capital asset of the entire society, and all members (even Ground Floor) must pay Service Charges equally unless the society's registered General Body has passed an explicit amendment granting exemption.

Our calculator allows you to turn on "Ground Floor Lift Exemption" with 1 click if your society has approved this resolution!

🚫 Legal Verdict: Strictly Illegal Beyond 10% of Service Charges

Legal Rule (Bye-Law 68 & Supreme Court / Govt Circular dated 13/01/2000): Absolutely NO. The Government of Maharashtra and Supreme Court have strictly ordered that Non-Occupancy Charges cannot exceed 10% of Service Charges (excluding Municipal Taxes). Any resolution passed by a society charging higher is legally null and void.

Our calculator automatically clamps this at 10% to protect your Managing Committee from consumer court complaints!

🚫 Legal Verdict: 0% NOC for Immediate Family Members

Legal Rule: NO. If the flat is occupied by immediate family members (parents, spouse, children, siblings), NO Non-Occupancy Charge can be levied. In our tool, simply select Owner Occupied for such flats.

⚖️ Legal Verdict: Equal Service Charges, Area-Based Funds

Legal Rule (Bye-Law 66 & Bombay High Court ruling): Service Charges (security, sweeping, office admin) must be divided EQUALLY among all units. However, for Sinking Fund, Repair Fund, and Insurance, commercial units pay higher amounts naturally because their carpet area is measured in the formula!

🚫 Legal Verdict: Simple Interest Only, Capped at Max 21% p.a.

Legal Rule (Bye-Law 71): Only Simple Interest up to a maximum of 21% per annum can be charged. Compound interest, arbitrary penalty fines, or cutting off electricity/water connections is strictly illegal under the MCS Act Section 154B.
